Welcome to Daytona Rooftop Restaurant Bar & Lounge (“Daytona Rooftop,” “we,” “us,” or “our”). These Terms of Service & Use (“Terms”) govern your use of our website, social media pages, online services, reservations, promotions, and other digital services operated by or on behalf of Daytona Rooftop. By accessing or using our website, social media pages, online ordering or reservation services, or other digital services, you agree to these Terms. If you do not agree, please discontinue use of those services.

Daytona Rooftop Restaurant Bar & Lounge is located at the Streamline Hotel in Daytona Beach, Florida. We provide restaurant, bar, lounge, entertainment, private-event, and related hospitality services.  Information posted on our website or social media pages is provided for general informational and promotional purposes and may be changed without prior notice.

Operating hours, menus, entertainment schedules, pricing, promotions, and availability are subject to change.  Menu items and beverages are subject to availability. Photographs of food, beverages, events, or the venue are for illustrative purposes and may not exactly represent the item or experience provided.  We reserve the right to modify or discontinue menu items, promotions, entertainment, operating hours, or services at any time.

Reservations are subject to availability and are not guaranteed until confirmed by Daytona Rooftop or an authorized reservation provider.  Large parties, private events, and special-event reservations may require a deposit, minimum food and beverage purchase, service charge, signed agreement, or other conditions.  Specific cancellation, deposit, minimum-spend, and refund policies may be provided at the time of booking. Those specific booking terms will apply in addition to these Terms.

Private parties, receptions, birthdays, weddings, corporate events, and other group functions may be subject to separate event agreements.  Event pricing, deposits, minimum spending requirements, service charges, cancellation policies, entertainment arrangements, and other conditions will be established in the applicable event agreement or booking confirmation.

Unless specifically authorized in writing by management, outside food and beverages are not permitted.

Alcoholic beverages are available only to guests who meet applicable legal drinking-age requirements and present acceptable identification when requested.  Daytona Rooftop reserves the right to refuse or discontinue alcohol service to any person when permitted or required by law, including anyone who appears intoxicated, cannot provide acceptable proof of age, or engages in unsafe or disruptive behavior.  Guests are responsible for consuming alcohol responsibly and arranging safe transportation when necessary.

Certain events, entertainment programs, areas, or operating periods may be restricted to guests who are 18+, 21+, or another age as permitted by law.  Age requirements for individual events may be announced separately. Valid government-issued identification may be required for admission or alcohol service.

Prices displayed online or on social media are subject to change.  Applicable sales taxes, gratuities, service charges, event fees, or other disclosed charges may be added to purchases or event bills.

Any applicable service charge is not necessarily a gratuity paid directly to an individual employee. Guests should refer to their receipt, event agreement, or other disclosure for details.

Deposits for reservations, private events, ticketed events, or special services may be refundable, partially refundable, or non-refundable depending upon the terms disclosed at the time of booking.  Cancellation deadlines and refund eligibility may vary by event.  Failure to attend a reservation or event does not automatically entitle the customer to a refund.

Happy hours, discounts, contests, giveaways, gift certificates, vouchers, complimentary offers, and other promotions may have separate eligibility requirements, expiration dates, blackout dates, restrictions, or redemption conditions.  Unless otherwise stated:

• Promotional offers cannot be exchanged for cash.
• Offers cannot be combined with other discounts or promotions.
• Lost or stolen promotional vouchers may not be replaced.
• Promotions are subject to availability and may be modified or discontinued where permitted by law.
• Alcohol-related promotions remain subject to applicable laws and responsible-service requirements.

Additional rules published for a particular contest, giveaway, or promotion will control if they conflict with these general Terms.

Gift certificates and promotional vouchers may be subject to specific restrictions stated on the certificate or voucher.  Unless otherwise specifically stated, certificates and vouchers cannot be redeemed for cash or used toward gratuities or tips.  Applicable expiration dates, blackout dates, transfer restrictions, and other conditions will be disclosed on the applicable offer where required.

When online ordering or payment services are available, customers are responsible for providing accurate order, payment, and contact information.  We reserve the right to reject or cancel an order because of product availability, pricing errors, suspected fraud, technical errors, or other legitimate business reasons.  Payment processing may be provided by third-party payment processors. Use of those services may also be subject to the provider's own terms and privacy policies.

DJs, musicians, performers, entertainment schedules, event times, and advertised activities may change because of weather, illness, operational requirements, circumstances beyond our reasonable control, or other reasons.  The cancellation or substitution of entertainment does not automatically create a right to a refund unless otherwise stated in the terms applicable to a ticketed or prepaid event.

Because Daytona Rooftop includes outdoor and rooftop areas, certain services, seating, events, and entertainment may be affected by weather.  For guest and employee safety, management may close or restrict outdoor areas because of rain, lightning, high winds, severe weather, or other unsafe conditions.

Guests are expected to behave respectfully toward employees, performers, other guests, hotel personnel, and property.  Daytona Rooftop reserves the right, subject to applicable law, to refuse admission or service or require a guest to leave for threatening, violent, abusive, excessively disruptive, unsafe, fraudulent, or unlawful behavior or for violation of venue policies.

Daytona Rooftop may maintain reasonable dress, safety, occupancy, and conduct policies.

Shirts and shoes may be required. Additional dress-code or admission requirements may apply to specific events and will be communicated where appropriate.

Daytona Rooftop is a public hospitality and entertainment venue where photography or video recording may occur.  At certain public or promotional events, Daytona Rooftop or its authorized photographers may photograph or record the venue and attendees for lawful promotional, advertising, archival, or social-media purposes, subject to applicable law.  Where an event requires a specific photography or publicity release, separate notice or consent may be obtained.

Guests may not use photography or recording equipment in a manner that violates another person's privacy, interferes with operations, or violates applicable law or venue policy.

Our official social media pages may allow users to post comments, reviews, photographs, videos, or other content.  Users are responsible for the content they submit. We may moderate, hide, or remove content from pages we control when reasonably necessary, including spam, threats, harassment, unlawful material, fraudulent promotions, impersonation, or content that violates platform rules.  References, tags, reposts, or links involving third parties do not necessarily constitute an endorsement by Daytona Rooftop.

Unless otherwise indicated, Daytona Rooftop's website content, branding, logos, graphics, photographs, promotional materials, menus, and other original materials are owned by or licensed to Daytona Rooftop and are protected by applicable intellectual-property laws.  Content may not be reproduced, distributed, modified, sold, or commercially exploited without permission from the applicable rights holder.

Our website or social media pages may contain links to third-party services, including reservation platforms, payment processors, delivery providers, social networks, entertainment providers, or other websites.  Daytona Rooftop does not control those third-party services and is not responsible for their independent content, policies, security, availability, or practices.

We strive to keep our website and digital services accurate and available but cannot guarantee uninterrupted or error-free operation.  Services may occasionally be unavailable because of maintenance, technical problems, internet interruptions, third-party outages, or circumstances beyond our control.

To the extent permitted by applicable law, our website, social media content, and digital services are provided on an “as available” basis.  We make reasonable efforts to maintain accurate information but do not guarantee that all online information will always be complete, current, or free from typographical or technical errors.  Nothing in these Terms excludes or limits rights or obligations that cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, Daytona Rooftop and its applicable owners, operators, affiliates, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of our website or digital services.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.

Information collected through our website, reservations, online orders, event inquiries, or other digital services will be handled in accordance with our applicable Privacy Policy and legal obligations.  Third-party platforms may separately collect and process information under their own privacy policies.

We may revise these Terms periodically.  Updated Terms will become effective when posted unless otherwise stated. Continued use of our website or digital services following an update constitutes acceptance of the revised Terms to the extent permitted by law.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.  Any dispute relating to these Terms will be handled in accordance with applicable Florida and federal law and any legally enforceable venue or jurisdiction requirements.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
